FOR ANTICIPATORY BAIL IN CRIME NO. 03/2023 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent Police for the alleged offence under Sections 409, 467, 468, 471, 477A, 420, 120B of IPC in Crime No.03 of 2023, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is employed in Central Co1/3

Operative Bank, Head Quarters, Tirunelveli. During his tenure, he disbursed the amount of Rs.2,42,00,000/- to other accused after obtaining fake jewels, salary certificates and other documents. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Further, he submitted that during his tenure, the petitioner disbursed the loan, which was valued of Rs.13,90,000/- only as salary loans and jewel loans. Thereafter, the entire loan transaction was disbursed by the other officers, but they are not arrayed as accused in this case, but however, the petitioner and his relatives were implicated as accused. Hence, he prays for grant of anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor would submit that there are 74 accused in this case and all those officers, who disbursed the amount involved were arrayed as accused. If the petitioner is granted anticipatory bail, there is possibility to tamper the witnesses and investigation may not be completed. Hence, he made objection to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the amount involved in this case, this Court is not inclined to grant anticipatory bail to the petitioner.
