ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) The relief sought for in the present Writ Petition is to direct the respondents to refer the husband of the writ petitioner, namely, Murugan, S/o.Kittappa, aged about 44 years, who is now detained at Central Prison, Trichy for treatment to any private hospital by considering the petitioner's representation dated 20.11.2023 within the time stipulated by this Court. 2.The learned counsel appearing for the petitioner has made a submission that even at the time of arrest of the husband of the writ petitioner, he was taking treatment in a private hospital and he is suffering from kidney related ailments. Therefore, the treatment in a private hospital is required. 3.The learned Additional Public Prosecutor appearing for the respondents has raised an objection by producing medical certificate issued by the 2/4
Assistant Surgeon, Central Prison Dispensary, Trichy and stated that medical conditions of the husband of the petitioner inside the prison is stable and he is under continued medical care in Prison Hospital. Further opinion has been given that his current medical condition does not require referral to tertiary care institution (Hospital). Further, it is contended that the husband of the petitioner is involved in four murder cases and in total 38 cases are pending. 4.This being the factum, we are not inclined to consider the Writ Petition and accordingly, this Writ Petition stands dismissed. The prison authorities shall provide required treatment if necessary for the prisoner.
