ORDER

The petition is for the transfer of investigation from the file of the third respondent to the file of the second respondent.

2. It is the case of the petitioner that though the occurrence took place on 01.10.2024, the respondents have not conducted any effective investigation; that they have not taken action against the officials of the private Bank; and that the accused had pledged the jewels, which were stolen from the petitioner's house.

3. The learned Additional Public Prosecutor, on instructions, would submit that the petitioner's son sought for similar prayer before this Court in Crl.O.P(MD.No.4461 of 2025 and this Court by order dated 11.03.2025 had rejected the prayer and directed the petitioner's son to 2/5

approach the third respondent with relevant documents to enable the third respondent to conduct the investigation in an effective manner and that the present petition, therefore is an abuse of process of law.

4. Admittedly, the transfer petition filed by the petitioner's son seeking the very same prayer was dismissed by this Court. Hence, this petition cannot be entertained at the instance of the mother. However, the learned Additional Public Prosecutor, on instructions, would submit that the third respondent, under the supervision of the Deputy Superintendent of Police would conclude the investigation and file a final report within a period of three months.

In view of the aforesaid submission, this Court directs the third respondent to consider the documents filed by the petitioner and file a final report within a period of three months from the date of receipt of a copy of this order. The Deputy Superintendent of Police shall monitor the investigation conducted by the third respondent. 3/5

6. With the above directions, this Criminal Original Petition is disposed of.
