Mr.S.S.Manoj (for R1) Government Advocate (Criminal Side) For Intervener : Mr.J.Vishnu ORDER : The Court made the following order :- This petition has been filed to modify the condition No.2 imposed by the learned Principal Sessions Judge, Ramanathapuram, in Cr.M.P.No. 1870 of 2025 dated 12.08.2025 and insofar as the deposit of 50% of the entire sum by the petitioner is concerned in Crime No.08 of 2025. 2.The learned counsel appearing for the petitioner submitted that the petitioner is working as a cab driver and he has not committed any offence as alleged by the prosecution. He further submitted that A3 is the appropriate person, who had indulged in job racketing. Therefore, he is unable to mobilize the required amount. Hence, he seeks modification of the condition.

3.Heard learned Government Advocate (Criminal Side) appearing for the respondent police.

4.The learned counsel for the intervener vehemently objected for modifying the condition.

5. Considering the nature of offence and arguments advanced by the petitioner's counsel that the petitioner is only a cab driver, the condition No.(ii) imposed by the learned Principal Sessions Judge, Ramanathapuram, in Cr.M.P.No.1870 of 2025 dated 12.08.2025, is modified as follows:

(ii)Before execution of bond, the petitioner shall pay Rs.50,000/- to the credit of Crime No.8 of 2025 before the learned Judicial Magistrate No.II, Ramanathapuram on the file of the respondent Police Station, without prejudice to his defence before the Judicial Magistrate concerned. 6.Accordingly, this Criminal Original Petition is disposed of.
