PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent to issue passport by considering the passport application of the petitioner dated 10.03.2025 and the representation dated 30.07.2025 within a stipulated time that may be fixed by this Court.

ORDER

The present writ petition has been filed seeking a mandamus directing the respondent to consider the application of the petitioner for issuance of the passport dated 10.03.2025 and the representation of the petitioner dated 30.07.2025.

2. According to the learned Counsel appearing for the writ petitioner, he was born and brought up in India and went to Malaysia with his father to eke out the livelihood. He had obtained Malaysian passport and it was later cancelled by the authorities on the ground that he is an Indian citizen.

3. According to the learned Counsel appearing for the writ petitioner, he has got an emergency certificate from the Indian Embassy in Malaysia and thereafter, landed in India.

4. Now the petitioner has made a request to the respondent officials seeking issuance of an Indian passport. Since the request was delayed, the present writ petition has been filed.

5. The learned Deputy Solicitor General of India appearing for the respondents submitted that the petitioner has acquired Malaysian citizenship and also got Malaysian passport from the said Government. In such circumstances, the petitioner cannot seek for Indian passport.

6. In view of the above said facts, the respondent official is directed to pass a detailed, reasoned order with regard to the request of the petitioner for issuance of the passport. The said exercise shall be completed within a period of 6(six) weeks from the date of receipt of a copy of this order.

7. With the above said observations, this writ petition stands disposed of. No costs.
