Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the refusal check slip in refusal Number RFL/Panpozhi/31/2025 dated 22.08.2025 issued by the respondent and quash the same as illegal, arbitrary and direct the respondent to register the petitioner's sale deed dated 22.08.2025 relating to Re.Sy.No. 15/2A1A1 and 16/1A1, admeasuring 4.65 Cents of Vadakarai Keelpidagai Village, Shenkottai Taluk, Tenkasi District within time frame.

Heard both sides.

2.The petitioner wants to purchase the petition mentioned property from Padmavathi. Sale deed dated 22.08.2025 was executed. It was presented for registration. Citing the bar under Section 22A of the Registration Act, 1908 registration was refused. Challenging the same, this writ petition has been filed.

3.The learned counsel for the petitioner points out that Padmavathi purchased the very same property vide sale deed dated 26.06.2019. It was registered as Document No.1168 of 2019 on the file of the respondent. What was purchased by Padmavathi has been sold as such. There is no change even in the boundary description. Since in the revenue record the property has been classified only as punjai, the petitioner gives an undertaking that without getting approval from the competent authority, he will not develop the land in question. 4.Recording the said undertaking, the impugned refusal check slip is quashed. The parties are permitted to re-present the document. It shall be registered and released subject to the fulfilment of the other usual formalities.
