Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned "Refusal Check slip" under RFL/Radhapuram/54/2025, dated 08.09.2025 issued by the third respondent and quash the same and to direct the third respondent to register the Sale Deed dated 28.08.2025 in respect of the lands to the extent of 22 Cents of lands comprised in Re-Survey No.218/9, Thiruvambalapuram Village, Radhapuram Taluk, Tirunelveli District, within a time frame as may be fixed by this Court. Heard both sides.

2.The petitioner wants to purchase the petition mentioned property from Suyambudurai. Sale deed dated 28.08.2025 was executed in this regard. It was presented for registration. The registering authority declined to register the document by citing the bar setout in Section 22A of the Registration Act, 1908. Challenging the said stand of the registering authority, this writ petition has been filed. 2/4

3.It is seen that the writ petitioner's vendor Suyambudurai purchased the very same property vide sale deed dated 02.12.2020 from Joy Alex. The said document was registered as Document No.5091 of 2020. There is no change in the description of the property. What was purchased by Suyambudurai is now being sold as such. Therefore, the registering authority cannot have any valid objection to the registration. 4.In this view of the matter, the impugned refusal check slip is quashed. The petitioner is permitted to re-present the document. It shall be registered and released subject to the fulfilment of the other usual formalities.

5.This Writ Petition is allowed accordingly. No costs.
