PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India, to direct the learned Principal Sub Court, Thanjavur to dispose the appeal suit in A.S.No.31 of 2023, dated 04.07.2023 on the file of the Principal Sub Court, Thanjavur within a stipulated time fixed by this Court by allowing the above Civil Revision Petition.

ORDER

This Civil Revision Petition has been filed seeking a direction to dispose of the A.S.No.31 of 2023 pending on the file of the learned Principal Sub Court, Thanjavur within a time stipulated by this Court.

2. According to the revision petitioner, the suit in O.S.No.171 of 2013 on the file of the learned Principal District Munsif, Thanjavur, seeking the relief of permanent injunction restraining the petitioner and other respondents from disturbing the enjoyment of the subject property by the respondents. In the meantime, the first respondent preferred an appeal in A.S.No.31 of 2023 on the file of the learned Principal Subordinate Judge, Thanjavur. The said suit is pending in the arguments 2/5

stage for the past eight months. Hence, the present Civil Revision Petition is filed.

3. Heard the learned counsel appearing for petitioner. Since the revision is filed for seeking early disposal, no notice is necessary to the respondent.

4. Having been taken into consideration of the material facts and circumstances, this Court is of the view that in the interest of justice, a direction may be issued to the learned Principal Sub Court, Thanjavur to dispose of the suit as expeditiously as possible.

5. Accordingly, this Civil Revision Petition stands disposed of with a direction to the learned Principal Sub Court, Thanjavur to dispose of the suit in A.S.No.31 of 2023 pending on his file, within a period of three (3) months from the date of receipt of a copy of this order on merits and in accordance with law.
