The above petition has been filed seeking orders to record the petitioner / third respondent as devolution of interest holder of fourth respondent in the above second appeal.
2. Heard the learned counsel appearing for the petitioner, the learned Senior Counsel appearing for the first respondent and the learned counsel appearing for the sixth respondent.
3. The learned Senior Counsel appearing for the first respondent and the learned counsel appearing for the sixth respondent would submit that they are not having any objections to allow the said petition and made an endorsement to the said effect.
4. The petitioner, who is the third respondent, in the affidavit filed in support of this petition, has stated that the fourth respondent, who is her brother, executed a settlement deed dated 28.07.2010 settling his share in the suit properties in her favour through power agent AR.Mohamed Ali Jinnah and as such, the fourth respondent has no right whatsoever in the subject matter of the second appeal and that therefore, the petitioner may be recorded as devolution of interest holder of fourth respondent.
5. Considering the above and taking note of the no objections given by the other side, this Court is inclined to allow the petition. Accordingly, this petition is ordered.
