PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to transfer the petitioner's complaint dated 17.11.2023 from the file of the third respondent to CBCID/4th respondent or any other independent Investigation Agency under the supervision of the first respondent and complete the investigation and consequently, take necessary action within a stipulated period as may by fixed by this Court.

ORDER

This petition has been filed to transfer the petitioner's complaint dated 17.11.2023, from the file of the third respondent to CBCID/4th respondent or any other independent Investigation Agency under the supervision of the first respondent.

2.The learned counsel for the petitioner would submit that it is a issue between the owner and tenant. Unnecessarily, the respondents 2 & 3 are interfering in this issue. The complaint dated 17.11.2023, is pending on the file of the third respondent herein. Hence, this petition. 3.As per the order passed by this Court dated 27.11.2023, the second respondent is appeared before this Court. 4.The learned Government Advocate (Crl.Side) on instructions from the second respondent submitted that on the complaint given by the petitioner enquiry was undertaken. During the course of enquiry, since it 2/4

is a dispute between the landlord and the tenant, the parties were advised to work out their remedy through civil process. Further, the petitioner gave an undertaking to vacate the premises. In view of the same, the complaint was closed.

5.In the circumstances, the parties have to workout their remedy through civil process, there is no question of enquiry by the fourth respondent herein. Accordingly, this criminal original petition stands dismissed.
