ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 341, 294(b), 323, 506(i) 1/3

and 380 IPC in Crime No.22 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to family dispute, the petitioner herein trespassed into the house of the defacto complainant, assaulted him with hands and abused him in filthy language and taken away 17 sovereigns of gold jewels. Hence, the case has been registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and her name has been falsely implicated in this case. He would further submit that it is a second anticipatory bail petition and the earlier petition filed by the petitioner was dismissed by this Court on 07.11.2023 in Crl.O.P(MD). No.19975 of 2023 stating that the petitioner is having seven previous case, but, the petitioner is not having any previous and seeks anticipatory bail.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the the petitioner herein is not having any previous case and the property has not been recovered. He would further submit that the investigation of the case is pending

5. Considering the serious nature of offence committed by the petitioner, the property has not been recovered and that there is no change of circumstances after dismissal of the earlier petition in Crl.O.P(MD).No.19975 of 2023, the petitioner is not 2/3

entitled for discretionary relief of anticipatory bail. The petitioner is directed to appear before the respondent police and co-operate with the investigation.
