Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Mandamus, directing the 1st respondent to give approval for the rectification of petitioner pay anomaly on par with petitioner junior namely P.Ganesan based on the proposal sent by the 3rd respondent dated 11.12.2020 as well as petitioner remainder representation dt.22.03.2024 and thereby direct them to pay enhanced pension and arrears within the time limit that may be stipulated by this Court.

O R D E R

This matter is listed under the caption "for being mentioned" at the instance of the learned counsel for the petitioner.

The learned counsel for the petitioner indicating that in paragraph No.2 of the order, dated 16.10.2025 the return has been mentioned as may 2010, whereas the return was actually made on 22.05.2023 and that since the petitioner has now been superannuated, it is for the first respondent, who is the competent authority to decide the said issue. Hence, in the fourth line of para No.2 of the order, the words "in the month of May 2020" shall be deleted and replace with "on 22.05.2023" and paragraph No.3 is requested to be substituted suitably.

3. There is justification in the submission of the learned counsel for the petitioner. Hence, this Court passed the following order: The date of return of the proposal mentioned in paragraph No.2, instead of "in the month May 2020", shall be substituted as "on 22.05.2023".

4. So also, paragraph No.3 shall be deleted and the following lines to be included as follows:

"3. In such view of the matter, the fourth respondent is 3/6

directed to clarify the queries raised by the third respondent and resubmit the proposal to the third respondent, who shall in turn forward the same to the first respondent, within a period of four weeks from the date of receipt of copy of this order. On receipt of such proposal, and as and when the third respondent forwards the proposal sent by the fourth respondent to the first respondent, the first respondent shall pass orders on merits and in accordance with law within a period of eight weeks from that day."

4. Registry is directed to carryout the above said correction and issue fresh order copy to the parties forthwith. 27.10.2025 LS To:
