ORDER

The petitioner sought a direction to direct the 1st respondent to register the FIR on the basis of the order passed by the learned District Munsif cum Judicial Magistrate No.1, Usilampatti passed in Crl.M.P.No.1768 of 2024 dated 23.10.2024.

It is seen that, the learned District Munsif cum Judicial Magistrate No.1, Usilampatti in Crl.M.P.No.1768 of 2024 dated 23.10.2024 had directed the Sub Inspector of Police, Usilampatit to conduct a preliminary enquiry and if any cognizable offence is made out, register a case, investigate and submit a report.

3. The learned Additional Public Prosecutor would submit that a report has already been filed before the learned Magistrate. However, he is unable to state as to when the report was filed.

4. In view of the rival submissions, with regard to the compliance of the order of the learned Magistrate, this Court is not inclined to issue any direction. However, if the petitioner is aggrieved by the non-compliance of any direction by the learned Judicial Magistrate by the respondents, it is always open to the petitioner to approach the learned Judicial Magistrate and seek appropriate remedy.

5. With the above said observations, this Criminal Original Petition is dismissed.
