ORDER : The Court made the following order :- The petitioner / Accused, who was arrested and remanded to judicial custody on 20.08.2024 for the alleged offence under Sections 7, 8 of Protection of Child from Sexual Offences Act, 2012, Section 9 of Protection of Child Marriage Act, 2006 and Section 351(2) of the BNS, 2023 @ Section 9 of Prohibition of Child Marriage Act, 2006, Sections 506(1), 376(3) of IPC and Sections 5(1) r/w. Section 6 of the Protection of Child from Sexual Offences Act, 2012, in Crime No.1 of 2024, on the file of the respondent police, seeks bail.

2. The learned Additional Public Prosecutor submitted that the investigation has been completed and the police report has been filed and the same is yet to be taken on file.

3. This Court had the advantage of going through the 164 statement recorded from the victim girl. Considering the nature of allegations made against the petitioner, who is a 33 year old man, who is said to have sexually assaulted the victim girl aged about 13 years, this Court is not inclined to enlarge the petitioner on bail at this stage. There must be some progress in the trial and atleast the victim girl should be examined and thereafter, this Court will consider granting bail to the petitioner.

4. In view of the above, this criminal original petition is dismissed for the present.
