2. Though the counter affidavit has been filed by the first respondent, upon going through the affidavit filed in support of the 1/2 https://www.mhc.tn.gov.in/judis
CMP(MD). No.16204 of 2025 application seeking condonation of delay, the averments made in the counter affidavit, and after hearing the learned counsel appearing for the parties, this Court is inclined to accept the reasons assigned by the applicant for condoning the delay of 239 days. More importantly, the connected appeals have already been numbered and are pending before this Court. Further, the delay is neither wilful nor wanton.
3. Accordingly, the delay of 239 days in filing the above Second Appeal is condoned, and this petition is allowed. 4..
