ORDER

This writ petition is filed seeking issuance of a Writ of Mandamus to direct the first respondent to renew and reissue the passport of the petitioner bearing No.L7557804 in passport Application No.MD4075469519725 dated 08.08.2025.

2. Mr.A.Devarajan, learned Central Government Standing Counsel, takes notice for the first respondent. Mr.S.Prakash, learned Government Advocate (criminal side) for the second respondent. By consent, this writ petition is taken up for final disposal at the time of admission itself.

3. The facts on record indicate that the petitioner was the holder of a passport bearing No.L7557804, valid from 04.03.2014 to 03.03.2024.

4. It is the case of the petitioner that, after the expiry of her passport, he applied for its re-issuance on 08.08.2025. In respect of the passport application (File No.MD4075469519725 ), the first respondent issued a letter dated 12.09.2025 seeking clarification regarding an adverse report from the second respondent, which stated that the petitioner was involved in Crime No.45 of 2022 for offences under Sections 294(b), 325, and 506(ii) of the IPC, chargesheeted in C.C.No.118 of 2022 on the file of the Judicial Magistrate No.II, Padmanabhapuram. Therefore, the petitioner has filed the present writ petition.

5. The learned counsel for the petitioner would submit that the C.C.No.118 of 2022 on the file of the Judicial Magistrate No.II, Padmanabhapuram has been closed in favour of the petitioner.

6. The learned Government Advocate (Crl. Side) for the second respondent also confirms the said submission.

7. Recording the said submission, this writ petition is allowed. The first respondent is directed to renew and reissue the passport of the petitioner bearing No.L7557804 by considering his passport Application No.MD4075469519725 dated 08.08.2025.
