ORDER : The Court made the following order :- The petitioner/accused, who arrayed as accused was arrested and remanded to judicial custody on 06.09.2023 for the offences punishable under Sections 302 and 201 IPC in Crime NO. 119 of 2023, on the file of the respondent police seeks bail. 1/3

2. The case of the prosecution is that the petitioner herein and other accused have joined together and committed the murder of the deceased. After committing the offence, A1 to A3 have tied the hands and legs of the deceased using rope and kept the dead body in a sack along with big stone and thrown the same into the well Aalavandan Village. Hence, the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is husband of the deceased and he is innocent and he has not committed any offence as alleged by the prosecution and his names has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 06.09.2023 and seeks bail.

The learned Additional Public Prosecutor appearing for the respondent would submit that it is a second bail petition and the earlier petition filed by the petitioner was dismissed by this Court on 17.11.2023 in Crl.O.P(MD).No.19637 of 2023. He would further submit that the petitioner is also present in the scene of occurrence and hence, he strongly opposed to grant bail to the petitioner.

5. Considering the gravity of offence and also considering the fact that there is no change of circumstances after dismissal of the earlier petition, this Court is not inclined to grant bail to the petitioner.
