PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent No.2 to impound the passport of the fourth respondent bearing Passport No.P9343210 under section 10(3)(e) of the Passports Act.

ORDER

The present writ petition has been filed seeking a mandamus directing the second respondent herein to impound the passport of the 4th respondent who is the husband of the writ petitioner.

2. According to the learned counsel appearing for the writ petitioner, she got married to the 4th respondent and she had already filed divorce proceedings before the competent Court. She has lodged a police complaint in Cr.No.3 of 2024 on the file of the All Women Police Station, Tallakulam, Madurai City, and it has culminated in filing of the charge sheet in C.C.No.1465 of 2024 on the file of the learned Judicial Magistrate No.II, Madurai. The petitioner has also filed D.V.C.No.137 of 2024 and the same is pending. According to the petitioner, in case, the passport of the 4th respondent is not impounded, he is likely to flee from the country.

3. The learned counsel appearing for the 4th respondent submits that he is regularly appearing before the trial Court concerned and he has no intention to flee from the country. He further undertakes that the 4th respondent would get the prior permission from the learned Judicial Magistrate No.II, Madurai wherein C.C.No.1465 of 2024 is pending, before leaving abroad.

4. With the above said observations, this writ petition is disposed of. No costs.
