ORDER : The Court made the following order :- The petitioner / accused apprehending arrest at the hands of the respondent police for the offences punishable under section 379 IPC in Crime No.157 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that when the defacto complainant was walking near Sivaram store at Virudhunagar, the petitioner herein and other accused have pulled the shirt of the defacto complainant and taken his cell phone forcibly and sped away from the scene of occurrence. Hence, the complaint.

3. The leaned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case and hence, he seeks anticipatory bail.

4. The learned Government Advocate (Crl. Side) would submit that the petitioner herein is having previous case in similar nature of offence and hence, he strongly, opposed to grant anticipatory bail to the petitioner.

5. Considering the serious nature of offence committed by the petitioner and also submission made by the learned Government Advocate (Crl. Side) appearing for the respondent that the petitioner herein is having previous cases in similar nature of offence, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3
