ORDER

The petitioners seek to quash the impugned final report filed for the offences under Sections 290 and 106(1) BNS.

2. The gist of the allegation is that the defacto complainant's father was working in the office of the petitioners and while cleaning the water tank, he fell down and the petitioners were guilty of the aforesaid offences for not providing adequate safety acquirements.

3. Admittedly, the petitioners and the second respondent have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 13.10.2025.

4. The defacto complainant and his mother, who is the wife of the victim, and his other brother are present before this Court in person and would state that the parties have arrived at a compromise and they do not wish to pursue the case. The petitioners are also present before this Court. They are identified by Mr.R.Jeyakaruppasamy, Special Sub 2/5

Inspector of Police, Virudhunagar West Police Station, Virudhunagar District. All the parties confirmed the compromise arrived at between them.

5. It is seen that the victim's wife and the defacto complainant's brother had signed a memorandum of understanding, agreeing to withdraw the complaint. The victim's wife and two sons are present and would confirm the compromise and would state that they do not wish to pursue the case.

6. Considering the nature of the offences and the compromise arrived at between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned final report pending trial. Accordingly, the impugned final report is quashed and the Criminal Original Petition stands allowed. The joint compromise memo dated 13.10.2025, shall form part and parcel of the order. The petitioners shall pay a cost of Rs.10,000/- (Rupees Ten Thousand only) to the credit of the "District Siddha Medical Officer, CCRI, Periyakulam" (Account No. 10767823177, IFSC Code: SBIN0000898, MICR Code: 625002601) and 3/5

file a photocopy of the receipt along with a memo reporting compliance in the Registry.
