R-8 suo motu impleaded vide order dated 27.01.2025 in W.P.(MD).No.29344/24 by RVJ) PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the 2nd respondent to calculate interest along with the principal as per the communication dated 14.06.2024 issued by the 4th respondent in PAG (A&E)/FM.1/VI/Admission/TRS-7117/2024-25/and credit the same as directed therein to the petitioner's GPF No.169962. ORDER
The instant writ petition has been filed by a Secondary Grade Teacher seeking a mandamus as against the second respondent to calculate the interest along with principle as per communication of the fourth respondent dated 14.06.2024 and credit the same to the petitioner's GPF Account No.169962.
2. The petitioner herein was initially appointed as a Secondary Grade Teacher in an aided school on 20.01.2001 and he served in the said school till 21.12.2009. While he was working in the aided school his provident fund 2/7
account was maintained under Aided School Teachers Provident Fund (ASTPF). The petitioner was selected as a Secondary grade teacher through Teachers Recruitment Board by way of order dated 14.12.2009 and he had joined in a Government School on 22.12.2009. Thereafter, PTPF account was opened in the name of the writ petitioner in the said Government School.
3. It is the grievance of the writ petitioner that the amount lying to the credit of his ASTPF account has not been transferred to PTPF account. A communication of the fourth respondent namely Accountant General, dated 14.06.2024, has been addressed to the second respondent to close the ASTPF account and closing balance may be transferred to PTPF account along with interest upto 31.03.2014. But, so far, no orders have been passed by the second respondent.

According to the learned Counsel appearing for the writ petitioner, though those order was issued by the fourth respondent on 14.06.2024, so far, the second respondent has not initiated any steps for transferring the closing balance along with interest. Hence, the present writ petition has been filed. 3/7

On instructions, the learned Additional Government Pleader appearing for the 3rd respondent would submit that the third respondent has addressed a communication dated 18.11.2024, to the Assistant Director of Local Fund Audit, Tirunelveli, requesting him to furnish the audit certificate for the above said issue. So far, the second respondent has not received any communication from the Local Fund Audit Department, Tirunelveli. He further submits that as and when the instructions are received from the Local Fund Audit Department, further progress is made in transferring the closing balance.

Considering the above said facts, this Court has suo motu impleaded the Assistant Director, Local Fund Audit Department, No.14, 2nd Street, Perumalpuram, Tirunelveli-627 007 as eighth respondent in the present writ petition. The Registry is directed to carry out necessary amendments in the writ petition.
7. In view of the above said facts, this Court is inclined to pass the following order:
a) The eighth respondent is directed to consider the proposal forwarded by the second respondent on 18.11.2024 and pass orders within a period of four weeks from the date of receipt of a copy of this order. 4/7
b) On receipt of the orders from the 8th respondent, the second respondent is directed to comply with the orders of the fourth respondent dated 14.06.2024 and pass order within a period of eight weeks thereafter.
8. With the above said observations, this writ petition is disposed of. No costs.
