O R D E R

This Criminal Original petition has been filed for directing the second respondent to complete investigation in Crime No.309 of 2024 and to file a final report.

2. The learned Counsel appearing for the petitioner would submit that the petitioner is the Defacto-complainant in the above said case. He lodged a complaint before the second respondent, based upon the said complaint a FIR has been registered in Crime No.309 of 2024 for the offences punishable under Sections 316(2) & 318(4) of BNS. The FIR has been registered on 24.07.2024, the second respondent has not completed the investigation within the statutory period. The case is pending for a long time. Therefore, the petitioner filed this present petition to direct the second respondent to complete the investigation and to file a final report. 2/6

The learned Government Advocate (Crl.Side) appearing for the respondent would submit that based upon the complaint given by the Defacto-complainant, a FIR has been registered in Crime No.309 of 2024 for the offences punishable under sections 316(2) & 318(4) of BNS. Based upon the confession statement of the Accused No.1 and 2, other accused persons arrayed in this case. Now they are in Newzeland, steps are being taken to bring them to India. In the above said circumstances, he seeks further time to complete the investigation.

4. Considering the submissions made by both side counsels, and considering the facts and circumstances of the case, it is appropriate to direct the second respondent to complete the investigation within a period of two months from the date of receipt of a copy of this order. 3/6

5. Accordingly, this Criminal Original Petition is allowed by directing the second respondent to complete the investigation in Crime No. 309 of 2024 within a period of two months and to file a final report. 04.02.2025 Index : Yes/No Internet : Yes/No gvn 4/6
