Mr.RMS.Sethuraman, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.33 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 20(b)(ii)(B) and 8(c) of NDPS Act and Section 77 of the Juvenile Justice (Care and Protection of Children) Act, 2015 in Crime No.33 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on a secrete information, the respondent Police enquired one Balasundar and found illegal possession of 130 grams of Ganja 1/3

and based on his confession, the other accused persons were also implicated. Hence, the case.

3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him. Hence he seeks anticipatory to the petitioner.

4.The learned Additional Public Prosecutor appearing for the respondent submitted that on a secrete information, the respondent Police enquired one Balasundar and found illegal possession of 130 grams of Ganja and based on his confession, the other accused persons were also implicated. Hence he objected to grant anticipatory bail to the petitioner.

5.Considering the nature of allegations levelled as against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
