ORDER

This Criminal Original Petition is filed to direct the 3rd Respondent not to harass the Petitioner under the guise of exercising his powers.

2. The petitioner is facing charges under Section 302 of IPC in S.C.No.401 of 2009 before the learned IV Additional District and Sessions Judge, Tirunelveli. The grievance of the petitioner is that pending the trial process, again harassment is made by the third respondent herein.

3. Learned Government Advocate (Crl.side) submitted that the petitioner is a notorious person who has involved not only this case under Section 302 of IPC, but also in two other cases. Only for watching the petitioner, surveillance was made. Except that no harassment is made by the respondents.

4. If the petitioner is involved in other cases, the third respondent herein is at liberty to summon the petitioners and conduct investigation. Without proper summon to the petitioner, it is not proper for the third respondent to make surveillance or watching the movement of the petitioner, which may interfere in his personal privacy.

5. With this direction, this Criminal Original Petition is disposed of.
