ORDER

This Criminal Original Petition is filed to call for the records relating to the charge sheet in Spl.S.C.No. 189/2024 pending on the file of the learned Special Court for POCSO Act Cases, Virudhunagar District at Srivilliputhur and quash the same as against the petitioner.

2. Learned counsel for the petitioner submitted that the case of the prosecution is that the petitioner was taking tuition for the school students and the victim who belongs to SC/ST community, was one among the students attending tuition. The petitioner developed a relationship with the victim and had indulged in penetrative sexual assault with the victim boy for more than one time. Hence a case in Crime No.361 of 2024 was registered against the petitioner for the offences under Sections 5(1), 6 of POCSO Act read with 3(2)(v) of SC/ST Act. The same culminated in laying a charge sheet in Spl.S.C.No. 189 of 2024 before the learned Special Court for POCSO Act Cases, 2/4

Virudhunagar District at Srivilliputhur. Seeking quashment of the final report the petition came to be filed.

3. When the matter was taken up for hearing, learned Government Advocate(Crl.side) on instructions, submitted that the victim has turned hostile before the trial Court.

4. In view of the above submission, the learned Judge, Special Court for POCSO Act Cases, Virudhunagar District at Srivilliputhur, is directed to conclude the trial in Spl.S.C.No.189 of 2024, pending in his file as expeditiously as possible, within a period of one month from the date of receipt of a copy of this order.

5. With the above direction, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petitions are closed. 19.02.2026 NCC : yes / no Index : yes / no Internet : yes / no pnn 3/4
