Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the third respondent to take appropriate action in the cancellation of Patta No. 2573 in Subdivision S.No. 642/2A2 and to issue separate patta in respect of pathway property in S.No.642/2A to the extent of 1000 sq.feet as per the Sale Deed in Doc.No.763/1996 dated 23.01.1996 in favour of the petitioner within a time stipulated by this Court. ORDER

Heard the learned counsel on either side.

2. Considering the order to be passed, issuance of notice to the private respondents is dispensed with.

3. The third respondent is directed to consider the petition mentioned representation dated 06.10.2022 and pass final order on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The third respondent will put 2/4

on notice all the interested parties including the private respondents herein before passing final order. I make it clear that I have not gone into the merits of the matter. It is open to the third respondent to pass order one way or the other.

4. This writ petition is disposed of accordingly. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
