This Petition is filed to condone the delay of 74 days in preferring the Criminal Appeal before this Court.
2. Heard the learned counsel appearing for the petitioner and Mr.K.Sanjay Gandhi, learned Government Advocate (Crl. Side) appearing for the respondent police and also perused the materials available on record.
3. Mr.K.Sanjay Gandhi, learned Government Advocate (Crl. Side) has raised only the formal objections.
4. Being satisfied with the reasons stated in the affidavit filed in support of this petition and also taking note of the fact that the petitioner is in custody, the delay of 74 days in preferring the Criminal Appeal is condoned. Accordingly, this Criminal Miscellaneous Petition is allowed.
