ORDER

The present contempt petition has been filed alleging violation of the orders of this Court dated 14.07.2020 in W.P.(MD)No.15034 of 2019 wherein this Court has directed the respondent management to pay subsistence allowance for the period between 05.12.2018 till the date of reinstatement namely 22.11.2021.

2. According to the learned counsel appearing for the management, the petitioner has given an undertaking letter on 08.07.2021 to the effect that he will not claim any subsistence allowance for this period. He further submits that despite this undertaking letter, 2/4

subsistence allowance has been paid for the period covering 05.12.2018 to 31.08.2020 on 06.09.2020. He further submits that in view of the undertaking letter, the subsistence allowance for the period covering 01.09.2020 to 22.11.2021 has not been paid.

3.According to the learned counsel appearing for the petitioner, such an undertaking letter has not been given by the petitioner and he disputes it.

4. In view of the above said facts, the contempt petition stands closed with liberty to the petitioner to initiate independent proceedings claiming subsistence allowance for the period covering 01.09.2020 to 22.11.2021.
