O RDER This criminal original petition has been filed seeking direction to the 2nd respondent for not harassing the petitioners in any manner forthwith against his wish.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that on the basis of the complaint given by the third respondent case in Crime No.1655 of 2023 dated 30.11.2023 has been registered. In pursuance of the above said FIR, summon was issued to the petitioner to appear.

3.Challenging the above said summon, this petition has been filed on the ground that over the issue between the parties, suit in O.S.No.428 of 2023 is pending on the file of the Sub Judge, Trichy. If it so, let them appear before the respondent and share the information with regard to the pendency of the suit with regard to the issue. The investigation may be taken to its logical conclusion. If any trouble arises, the parties may workout their remedy through appropriate proceedings. 2/4

4.With the above said directions, this criminal original petition stands disposed of.
