This Criminal Miscellaneous Application is filed by the applicant viz., A.John Edward, who is the Respondent in the Criminal Revision Petition, to permit him to withdraw the amount of Rs.7,00,000/- which was already deposited by the Revision Petitioner before the trial Court on various occasions.
2.Heard Mr.S.Sukumar, learned Counsel for the applicant and Mr.K.Sasi Prabha, learned Counsel representing Mr.G.Prabhu Rajadurai, learned Counsel for the respondent/Revision Petitioner. 3.Mr.S.Sukumar, learned Counsel for the applicant submits that the Revision Petitioner has already deposited a sum of Rs.5,00,000/- before the Judicial Magistrate No.IV, Tiruchirappalli, as per the direction of the learned I Additional District and Sessions Judge (PCR), Tiruchirappalli. It was further submitted that in compliance with the order passed by the 2/5
Co-ordinate Bench of this Court dated 10.07.2023, the Revision Petitioner viz., C.Jancy, has also deposited a sum of Rs.2,00,000/- to the credit of C.C.No.101 of 2014 on the file of Judicial Magistrate No.IV, Tiruchirappalli. He further submits that the applicant may be permitted to withdraw the amount of Rs.7,00,000/-, which was already deposited by the Revision Petitioner before the trial Court on various occasions. 4.Accordingly, after considering the arguments as advanced by the learned counsel for the parties, the applicant viz., A.John Edward is permitted to file an application before the Judicial Magistrate Court No.IV, Tiruchirappalli, for withdrawal of Rs.7,00,000/- which was already deposited by the Revision Petitioner to the credit of C.C.No.101 of 2014 on the file of Judicial Magistrate Court No.
IV, Tiruchirappalli, on various occasions, within a period of ten days from today and if any such application is filed by the applicant viz., A.John Edward, within the time stipulated by this Court, the learned Judicial Magistrate No.IV, Tiruchirappalli, is directed to disburse the said amount to the applicant viz., A.John Edward within a period of ten days thereafter.
5.With the above directions, this Criminal Miscellaneous Petition is disposed of. There is no order as to costs. File is consigned to record.
