ORDER

Heard both sides.

2. The question that calls for consideration is the site where the Direct Purchase Centre is to be located. The petitioner contends that Survey No.90 is not appropriate. He points out that an Anganwadi Centre is located in the vicinity and that if the building is constructed in that spot, interests of the children would suffer. That is why, I granted an order of interim injunction.

3. It is now submitted by the learned Government Advocate that Anganwadi Centre has since been shifted to another place.

4. I direct the District Collector, Tanjore District to take decision in the matter immediately. The first respondent will take into account the 2/4

representation of the impleaded respondent as well as the objections of the writ petitioner and pass a final order. It is not for the writ Court to decide the site. It is for the District Collector to take decision in the matter. As and when such decision is taken, copy of the same will be served on all the parties concerned.

5. The Writ Petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
