O R D E R

The petitioner has approached this Court, seeking a Mandamus, directing the second respondent to conduct an enquiry and to take action as against the third and fourth respondents, by considering his representation dated 29.08.2024. 2.The petitioner is working as a Junior Assistant in Ramasamy Tamil College, Karaikudi. The third and fourth respondents are the Principal and Assistant Professor of the same College. The petitioner was allotted for the supervision of Semester examination held in the year 2023. When he approached the respondents 3 & 4 for his remuneration, he came to know that by forging the petitioner's signature, the respondents 3 & 4 have received the petitioner's remuneration. Therefore, the petitioner has lodged a complaint before the Alagappauram Police Station in CSR No.320/2023. However, no action has been taken by the Inspector of 2/6

Police, Alagappapuram. Therefore, the petitioner has approached the Judicial Magistrate Court, under Section 156(3) of Cr.P.C and the same is pending in Cr.MP.No.2546 of 2024. According to the petitioner, for having lodged a complaint as against the respondents 3 & 4, they are harassing the petitioner. Therefore, the petitioner has made complaint before the District Collector, Sivagangai/the first respondent herein to take action as against the respondents 3 & 4 and the first respondent has forwarded the same to the second respondent and the second respondent, in turn, has forwarded the same to the Secretary of the Ramasamy Tamil College, Karaikudi. Since the respondents are the Principal and Assistant Professor of the College, no action has been taken by the Secretary of the College. Therefore, the petitioner is constrained to approach this Court.

3.Mr.R.Balakrishnan, learned counsel takes notice for the third and fourth respondents and submits that the allegations made as against the respondents 3 & 4 are baseless. 3/6

4. The learned Government Advocate appearing for the respondents submits that the representation of this petitioner dated 29.08.2024 was received by them and they have also contemplated an enquiry.

5.This Court considered the rival submissions made and also perused the materials placed on record.

6.It appears that the petitioner has made serious allegations in his representation dated 29.08.2024 that the Principal and the Professor of Ramasamy Tamil College, Karaikudi have taken the remuneration of this petitioner by forging his signature. It is reported that the second respondent has already commenced an enquiry with regard to the allegations made. Since the representation of this petitioner, dated 29.08.2024 is acted upon, this writ petition is closed with a direction to the second respondent to conclude the 4/6

enquiry within a period of eight weeks from the date of receipt of a copy of this order. No costs.
