ORDER : The Court made the following order :- The petitioner / Accused No.1, who was arrested and remanded to judicial custody on 19.08.2024 for the alleged offence under Sections 341, 307, 302, 147, 148, 120(b) of IPC, in Crime No.10 of 2021, on the file of the respondent police, seeks bail. 1/3
2. The petitioner did not appear before the trial Court on 05.01.2024 and hence, NBW was issued against the petitioner. The same was able to be executed only on 02.09.2024 and the petitioner was produced before the Court and he was remanded to judicial custody.
3. The learned Additional Public Prosecutor (Criminal Side), on instructions, submitted that there are totally 10 accused persons in this case and the petitioner has been arrayed as A1. He further submitted that there are 5 previous cases against the petitioner.
4. In the considered view of this Court, once an accused person jumps bail, the Courts must get more strict, since the accused person has misused the liberty. That apart, the case is only at the stage of framing of charges. There are totally 10 accused persons in this case. The pattern seems to be that one accused after the other will keep absconding and as a result, there will be no progress in this case. This design, on the part of the accused persons, must be curbed by the Court. Therefore while considering a bail petition where an accused person has jumped bail, the Court must be more strict and bail should not be granted for a mere asking.
5. In view of the above, this Court is not inclined to enlarge the petitioner on bail at this stage. Let there be some progress in this case and thereafter, this Court will consider granting bail to the petitioner. 2/3
