(Order of the Court was made by C.V.KARTHIKEYAN, J.) This application has been filed to condone the delay of 394 days in filing the appeal against the judgment in O.S.No.49 of 2015 on the file of the Additional District Court, Dindigul.

2. In the affidavit filed in support of this petition, it had been stated that the delay was caused owing to approval being obtained from the higher authorities and also legal opinion regarding the filing of the appeal. It had also been stated that in all these procedures the delay has occurred.

3. Notice had been directed to the respondents and notice had been served. The learned counsel entered appearance. He submitted that the respondent has also filed an against the very same judgment and both appeals have to be heard together.
