2. The learned Government Advocate (Crl.Side) would submit that on the basis of the complaint given by the fourth respondent, enquiry was undertaken. During the course of enquiry, both sides appeared. The petitioner also gave an undertaking that he will settle the issue, after selling the property, within three months from the date of enquiry. On the basis of the above said undertaking, the above said enquiry was closed on 28.11.2023.

3. Now the grievance of the petitioner is that on the basis of the complaint given by the fourth respondent herein, summon was issued to the petitioner. The petitioner appeared before the third respondent herein, at that time, he was forcibly ordered to transfer Rs.50,000/- to the 2/4

account of the fourth respondent. According to the learned counsel for the petitioner, the above said undertaking was obtained by force.

4. If it is so, the petitioner can made a complaint before the first respondent and he can workout his remedy through appropriate process. Since the above said enquiry was closed on 28.11.2023, nothing survives for further consideration or direction in this matter. Now the matter has become infructuous.

5. With the above said liberty, this Criminal Original Petition is dismissed as infructuous.
