ORDER
This Writ Petition has been filed to direct the third respondent to dispose of the CSR No. 909/2024 dated 24..10.2024 by taking necessary action on petitioner's complaint dated 23.10.2024 pending before the fourth respondent within stipulated time as fixed by this Court
2. The petitioner had lodged complaint on 24.10.2024 for which CSR No.909 of 2024 assigned. Thereafter no enquiry was conducted, He further submitted that this being so from the counter complainant complaint has been received and the case has been registered against the petitioner . The police are acting in a partisan manner, hence he has filed the present petition
3. The learned Additional Public Prosecutor submitted that on enquiring both the parties since it is civil in nature the complaint has been enquired and closed on 06.11.2024 2/5
4. The learned counsel appearing for the petitioner submitted that the petitioner was not aware about the closure report and further when counter complaint has been registered in Crime No. 410 of 2024 and in all forms the petitioner's complaint ought to have been registered.
5. In view of the same, the closure report in CSR No. 909 of 2024 dated 06.11.2024 is set aside. The Inspector of Police, Kodaikanal Police Station is directed to submit the complaint of the petitioner with all relevant materials to the Deputy Superintendent of Police, Kodaikanal who shall conduct enquiry in this regard. The enquiry process to be completed within a period of two months.
6. With the above direction, the Writ Petition stands disposed of. No costs.
