ORDER

Heard both sides.

2.The writ petitioner is the purchaser of the petition mentioned land. The sale deed dated 16.09.2025 was executed in the writ petitioner's favour. It was presented for registration before the third respondent. Citing under valuation, registration has been refused. Challenging the stand of the registering authority, this writ petition has been filed.

3.The learned Counsel for the petitioner is right in his contention that if the registering authority has any issue regarding valuation, the only course of action upon to him is to register the document and refer it under Section 47A of the Stamp Act. He cannot withhold on this ground. 2/4

4.The impugned refusal check slip is quashed. The petitioner shall represent the document and the same shall be registered. If the authority is of the view that reference under Section 47A of the Stamp Act is necessary, he or she may do so. I make it clear that the registering authority need not seek clearance or approval from his superiors. He or she may straight away refer the document to the Special Deputy Collector for Stamps.
