Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Declaration, to declare the first petitioner as guardian of second petitioner namely Selvakumar, S/o.Viswanathan, who is a mentally retarded person, and manager to administer and operate the bank accounts of second petitioner and his father Late.Viswanathan and in the event of necessity to handle the movable and immovable properties standing in the name of second petitioner as well as his father for the welfare of second petitioner. This writ petition has been filed to declare the first petitioner as guardian of second petitioner namely Selvakumar, S/o.Viswanathan, who is a mentally retarded person, and manager to administer and operate the bank accounts of second petitioner and his father Late.Viswanathan and in the event of necessity to handle the movable and immovable properties standing in the name of second petitioner as well as his father for the welfare of second petitioner.

2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3. Heard the learned counsel appearing on either side and perused the materials placed before this Court.
4. Without expressing any opinion on merits of the writ petition, the third respondent is directed to consider the request made by the petitioner after conducting an enquiry and submit a report before the first respondent within a period of four weeks from the date of receipt of a copy of this order. On receipt of the same, the first respondent and its committee pass orders on the request made by the petitioner on merits and in accordance with law based on the report submitted by the third respondent within a period of eight weeks, thereafter.
