ORDER

This Writ Petition has been filed seeking to direct the first respondent to re-issue passport to the petitioner, based on his application in File No. MD1076948992324 dated 19.09.2024.

2.By consent of both parties, considering the limited relief sought for by the petitioner, the Writ Petition is taken up for final disposal at the stage of admission itself.

3.Heard, the learned counsels on either side and perused the materials on record.

4.The first respondent on receipt of the police adverse report from the second respondent that a case in Cr.No.54 of 2024 on the file of second respondent Police is pending against the petitioner, sought for explanation from the petitioner, by issuing a show-cause notice, dated 22.10.2024, for which, the petitioner has duly submitted his explanation. 5.In the meanwhile, the FIR in Cr.No.54 of 2024 culminated in filing of charge sheet before the jurisdictional Judicial Magistrate, Andipatti, in 2/5

which, the petitioner's name, which was registered as A5 in the said FIR came to be removed.

6.In view of the same, as on date, there is no case pending against the petitioner.

7.Considering the fact that the petitioner has no pending criminal antecedents against him, the first respondent is hereby directed to consider the application of the petitioner seeking for re-issuance of passport in File No. MD1076948992324 and re-issue passport within a period of 6 weeks from the date of receipt of copy of this order.

8.Accordingly, this Writ Petition is allowed on these terms. There shall be no order as to costs.
