ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent Police for the alleged offence under Sections 417, 420, 294(b), and 506(i) of IPC, in Crime No.293 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant is a deserted women and is living along with her children. In such circumstances, the petitioner was introduced with the defacto complainant and thereafter, he promised to marry her and received 32 sovereigns of gold and the same was pledged for his business 1/3

purpose. Thereafter, on 22.10.2023, while the defacto complainant questioned him about her jewels, the petitioner refused to return the jewels and threatened her with dire consequences. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that that the petitioner has not committed any offences as alleged by the prosecution. Further he would submit that, the petitioner and the defacto complainant are in living relationship and a false case has been foisted against the petitioner. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the State would submit that investigation is at preliminary stage and if the petitioner is enlarged on anticipatory bail, there is possibility of tampering the witness and it will hamper the investigation process. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also considering the gravity of offences made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
