ORDER

This contempt case has been filed complaining willful disobedience of the order dated 12.07.2024 in W.P.(MD)No.15759 of 2024.

While disposing of the said Writ Petition, this Court directed the respondents to consider the representation of the Petitioner dated 03.07.2024 and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of the order. In the said order, it is made clear that, it is appreciable, if the above said exercise is done before passing any order of promotion to the post of Senior Lecturers by considering the persons in the promotion panel dated 03.07.2024.

3. The learned counsel appearing for the respondents submits that the representation of the petitioner dated 03.07.2024 has been considered

by the respondents and orders have been passed on 11.11.2024, wherein the request of the petitioner was rejected.

The learned Counsel for the petitioner would submit that while disposing of the Writ Petition, this Court expressed its view that W.P.No.16686 of 2023 dated 14.03.2024 is squarely applicable to the case of the petitioner and as such, the respondents ought to have disposed of the representation of the petitioner in the lines of the said judgment. But now, this Court is not inclined to interfere into that aspect.

Considering the direction issued to the respondents to dispose of the representation and pass appropriate orders within the stipulated time and considering the fact that the representation was disposed of by the respondents on 11.11.2024, in our considered view, there is no willful disobedience of the order of this Court dated 12.07.2024 in W.P.(MD).No.15759 of 2024, on the part of the respondents in complying with the same.

6. Accordingly, no further adjudication is required in this Contempt Petition. Hence, this Contempt Petition stands closed.

7. However, it is made clear that the petitioner is at liberty to challenge the order dated 11.11.2024 issued by the second respondent (Director, State Council of Educational Research and Training (SCERT), DPI Campus, College Road, Chennai - 600 006), if so advised. 13.03.2025 NCC : Yes/No Index : Yes/No Internet : Yes Sn To 1.Mr.S.Madumathi, The Principal Secretary to Government, School Education Department, Fort St.George, Secretariat, Chennai - 600 009.
