PRAYER:

FOR BAIL IN CRIME NO.118 OF 2013 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner / A11, who was arrested and remanded to judicial custody on 04.01.2023 on execution of Non-Bailable Warrant issued by the learned III Additional Sessions Judge, Tirunelveli, for the offences punishable under Sections 120(b), 147, 1/3

148, 341, 302 r/w 149 of IPC in S.C.No.22 of 2023, seeks bail.

2. The petitioner was absent during the trial in S.C.No.22 of 2023 on 11.11.2021 pending on the file of the III Additional Sessions Judge, Tirunelveli. Thereby, Non Bailable Warrant came to be issued on 11.11.2021. Pursuant to the same, the petitioner was arrested and remanded to judicial custody on 04.01.2023. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that this is the fourth bail petition. Earlier petition filed by the petitioner in Crl.OP (MD)No.7147 of 2023 was dismissed by this Court, on 18.04.2023. The petitioner is in judicial custody from 04.01.2023. Hence, he prays for grant of bail to the petitioner. 4.

Heard the learned Additional Public Prosecutor appearing for the State would submit that the non bailable warrant was issued in the year 2021 and he was secured in the year 2023. The petitioner is having 30 previous cases. This is the fourth bail petition. There is no change of circumstances. If he is enlarged on bail, there will no progress in the trial process. Hence, he vehemently, opposed to grant bail to the petitioner.

5.Considering the facts and circumstances of the case and also considering the fact that there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
