ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w. Section 20(b), (ii)(B) and 25 1/3

Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.198 of 2023 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on receiving secret information the respondent police has conducted a raid on 23.07.2022 and at that time, the petitioner herein and other accused have illegally found in possession of 2 kgs of ganja. Hence the case.

3. The learned counsel appearing for the petitioner would submit that based on the confession of co-accused only the petitioner herein is arrayed as accused and he is innocent and seeks anticipatory bail.

4. The learned learned Additional Public Prosecutor appearing for the respondent would submit that the petitioners herein and other accused have illegally found in possession of 2 kgs of Ganja and hence, strongly objected to grant anticipatory bail to the petitioner.

5. Considering the serious nature of allegations made against the petitioner and also considering the gravity of offence, this Court is not inclined to anticipatory bail to the petitioner.
