ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent 1/3
police for the alleged offence under Sections 498(A), 406, 506(i) IPC in Crime No.28 of 2024 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that A1 married the defacto complainant in the year 2019. There is a male child out of marriage. The matrimonial dispute has arisen and the defacto complainant has given a complaint stating that she was treated with cruelty and there was demand for dowry and that all her jewellery has been retained by the accused persons.
3.Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl.Side) appearing for the respondent. 4.Taking into consideration of the facts and circumstances of the case and considering the fact that there is a matrimonial dispute between the parties and custodial interrogation may not be required, the respondent Police is directed to resort to the procedure adumbrated under Section 35 of BNSS Act and complete the investigation as expeditiously as possible.
