ORDER
The petitioner has filed this Writ Petition for a mandamus, directing the respondents to rectify the Patta No.1212 and 1816, by removing the names of Sundar and Syed Abdul Kadhar respectively, as per the petitioner's representation, dated 16.11.2024.
2. The subject property in Survey No.439B, measuring an extent of 1 Hectare 16.5 Ares, situated at Vadavallanadu Village, Srivaikundam Post, Thoothukudi District, was purchased by the petitioner's grandfather, and joint patta was issued in the names of petitioner's father and his brothers, namely, Perumal @ Durai and Krishnan. While so, the name of Syed Abdul Kadhar was wrongly included in patta No.1816. Likewise, the name of one Sundar was wrongly added in patta No.1212. Therefore, the petitioner submitted a representation to the respondents on 16.11.2024, to rectify the aforesaid pattas, by removing the additional names. As no action was taken, the petitioner filed the above writ petition for the aforesaid relief.
3. The learned Government Advocate, on instructions, submits that notice of enquiry has been issued to the petitioner to attend for enquiry
on 23.01.2025. He would further submit that proceedings have already been initiated and therefore reasonable time be granted for passing final orders.
4. In view of the fact that enquiry notice has been sent, fixing the date of enquiry on 23.01.2025, on the basis of the petitioner's representation, the second respondent is directed to conclude the proceedings and pass orders on merits and in accordance with law within the time-line mentioned in the Circular, dated 17.07.2023, of the Commissioner of Land Administration, Chennai.
5. Writ Petition is disposed of accordingly. No costs. 22.01.2025 NCC :
