ORDER

This writ petition has been filed for a Mandamus, seeking a direction to the respondents to pay all the monetary benefits and death cum terminal benefits in respect of the deceased Mr.Rajendran within a time frame fixed by this Court.

2.During the pendency of this writ petition, the third and fourth respondents were impleaded as party respondents by order dated 02.04.2025 passed by this Court in W.M.P(MD)No.22677 of 2024. The third and fourth respondents had also claimed payment of death cum retirement benefits on account of the death of Mr.Rajendran and they are the rival claimants of the petitioners.

3.It is now brought to the notice of this Court by the learned Counsels appearing for the petitioners as well as the third and fourth respondents that if a direction is issued, a joint representation will be given by the petitioners and the third and fourth respondents, since the petitioners and the third and fourth respondents have amicably resolved the dispute among themselves, seeking payment of death cum retirement benefits payable to the deceased Mr.Rajendran and a direction may be issued to the Transport Corporation (respondent) to consider the joint representation on merits and in accordance with law and pass final orders within a time frame to be fixed by this Court. 4.

Even though a positive direction has been sought for in this writ petition, the learned Counsels appearing for the petitioners as well as the third and fourth respondents would submit that it would suffice if the joint representation of the petitioners as well as the third and fourth respondents to be submitted to the respondent Transport Corporation is considered on merits and in accordance with law, within a time frame to be fixed by this Court.

It is for the first and second respondents (Transport Corporation) to consider the same on merits and in accordance with law. 5.Accordingly, this Court directs the petitioners and the third and fourth respondents to submit a joint representation to the first respondent seeking for payment of death cum terminal benefits as prayed for in this writ petition payable on account of the death of Mr.Rajendran, who was an employee of the respondent Transport Corporation, within a period of two weeks from the date of receipt of a copy of this order.
