Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, forbearing the respondents from chopping or cutting any trees there at S.No.1704/1 in Thadikombu Town Panchayat, Dindigul District citing laying of roads except under due process of law considering the representation dated 13.11.2024.

This writ petition has been filed to forbear the respondents from chopping or cutting any trees comprised in S.No.1704/1, situated at Thadikombu Town Panchayat, Dindigul District.

2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

4. The petitioner is residing in the Poonthottam, Thadikombu. Now the land comprised in Survey No.1704/1 situated at Thadikombu Town Panchayat, Dindigul District is classified as Government Poramboke. While being so, there is a complaint lodged by the villagers alleging that the petitioner encroached some portion of the Government poramboke land. The subject land is used by the general public as pathway. Therefore, the fourth respondent conducted survey over the subject land. There is absolutely no proposal to remove or cut any tree situated at Survey No.1704/1. 2/4

5.In view of the above submission, the respondents are directed to remove any encroachment in the Government Poramboke land comprised in Survey No.1704/1 of ThadikombuTown Panchayat, Dindigul District, if any, within a period of four weeks from the date of receipt of a copy of this order. At the same time, if any road is proposed to lay in the subject land, the respondents are directed not to remove any tree and accordingly lay the road.
