Respondent/Writ Petitioner PRAYER: Writ Appeal filed under Clause 15 of Letters Patent, praying to set aside the order dated 26.09.2022 passed in W.P.(MD).No.21544 of 2016 on the file of this Court and allow this Writ Appeal. JUDGMENT
(Judgment of the Court was made by M.S.RAMESH,J.) This Writ Appeal has been filed against the order of the learned Single Judge in W.P.(MD).No.21544 of 2016 dated 26.09.2022.
2. In the impugned order of the Writ Court, we do not find any positive directions to the appellants to regularize the services of the respondent herein. On the other hand, we find that the Writ Court had only directed the appellants to consider the case of the respondent herein in the light of G.O.(2D)No.85, Agriculture Department, dated 15.06.2013. In the absence of any positive directions for regularization, we fail to understand as to how the appellants could be aggrieved against the order of the Writ Court. If at all the appellants are of the view that the respondent herein would not be entitled for the benefits
of G.O.(2D)No.85 dated 15.06.2013, it will always be open to them to adduce reasons for such a decision while passing final orders pursuant to the directions of the Writ Court.
3. Accordingly, we do not find any reasons to interfere with the order of the Writ Court and hence, the Writ Appeal stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed. (M.S.R.,J.) (A.D.M.C.,J.) 29.01.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No Lm
