PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to pass an order calling for the Charge Sheet in STC.No.828 of 2023 on the file of the learned Judicial Magistrate No.I, Kuzhithurai, and Quash the same in so far as the petitioner is concerned.

ORDER

This petition has been filed seeking quashment of proceedings in STC.No.828 of 2023 on the file of the learned Judicial Magistrate No.I, Kuzhithurai.

2.After hearing, the learned counsel for the petitioner would submit that he would be satisfied to issue a direction to the trial Court to complete the trial process within a time stipulated by this Court. 3.In view of the submission made by the learned counsel for the petitioner, the learned Judicial Magistrate No.I, Kuzhithurai, is directed to complete the trial process in STC.No.828 of 2023 within a period of 3 months from the date of receipt of a copy of this order.

4. with the above direction, this Criminal Original Petition is disposed of without going to the merits of the case. Consequently, the connected miscellaneous petitions are closed. 2/4

5.considering the age of the petitioner and the close relationship between him and the defacto complainant, his personal appearance before the concerned trial Court is dispensed with on the following conditions;

(i)The petitioner shall appear before the learned Judicial Magistrate No.I, Kuzhithurai, within a period of 15 days from the date of receipt of a copy of this order and file an undertaking affidavit, by affixing his recent passport size photograph, to the effect that he will appear before the trial Court as and when required and must ensure his proper representation through Advocate.
