Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the 1st respondent to transfer the investigation in Case in Crime No.708 of 2023 pending investigation on the file of 3rd respondent to other investigation agency.

ORDER

The petitioner seeks a direction to the 1st respondent to transfer the investigation in Case in Crime No.708 of 2023 pending investigation on the file of 3rd respondent to other investigation agency.

2. It is seen from the records that the petitioner's complaint is closed as undetected; that the report of the Police was rejected by the learned Magistrate by order dated 03.07.2024 in Cr.M.P.No.442 of 2024; and that the learned Magistrate directed the Inspector of Police, Panagudi Police Station to transfer the investigation to another Sub-Inspector of Police. The above facts are not disputed by both the parties.

3. It is now reported that the then Inspector of Police is now transferred to another Police Station. In view of the same, the present Inspector of Police, Panagudi Police Station, shall conduct the investigation under the supervision of the second respondent.

4. With the above direction, this Criminal Original Petition is disposed of.
